Terms of Service
Effective date: August 12, 2026
These terms are the agreement between you and Millis Digital LLC, the company that operates YumScout ("YumScout," "we," "us"), for using the YumScout app and yumscout.app (together, the "Service"). By creating an account or using the Service, you agree to them. We've written them in plain English on purpose — there is no fine print doing secret work.
1. What YumScout is (and isn't)
YumScout is a marketplace platform: a live map where independent street food vendors show their location in real time and customers find them, follow them, and order ahead for pickup.
Vendors are the sellers, not us. Every vendor on YumScout is an independent business. When you buy food through YumScout, the sale is between you and the vendor — the vendor is the merchant of record, their name appears on your card statement, and they prepare, price, and hand you the food. YumScout does not make, sell, or deliver food. We provide the map, the ordering software, and the payment rails, and we charge vendors a subscription and a per-order platform fee for it.
2. Your account
YumScout requires an account: you sign in (or create an account — it takes one tap with Apple, or an emailed link) when you open the app, and everything you do there — browsing, ordering, following, reviewing — happens through it. When you create an account you choose whether you're here as a customer or as a food-truck vendor; vendor accounts continue into the vendor application (section 5). You must be at least 13 to have an account (and if you're under 18, you should have a parent or guardian's permission to place orders). Keep your sign-in credentials to yourself — you're responsible for what happens on your account. Give us accurate information, and don't impersonate anyone. You can delete your account at any time in the app (Profile → Delete account); our Privacy Policy explains exactly what deletion does.
3. Ordering, payment, and pickup
- All orders are for in-person pickup at the vendor's location. YumScout has no delivery.
- Prices are set by the vendor. Payment is processed by Stripe when you place the order; your card details go to Stripe, never to us.
- Tips are optional and 100% of your tip goes to the vendor — YumScout takes no cut of tips.
- When your order is ready, show your pickup code at the window. Pick up within 2 hours. If an order is never collected, the vendor keeps the payment. The food was made and the vendor waited, so the money stays with them. That rule is shown at checkout before you pay, not only here. If you believe you were charged for food you never got, ask the vendor to make it right, and email support@yumscout.app with your order code within 7 days if you can't reach them — we can settle it by hand.
- Vendors may accept or decline orders (a taco truck in a rush is allowed to be slammed). Declined orders are refunded in full, automatically.
- Kitchens run out of things and equipment breaks. A vendor who can't finish your order can refund it — in full, or for the part they couldn't make. Those refunds are the vendor's decision, not an automatic one, and we'll step in if you can't resolve it with them.
4. Refunds and cancellations
The refund rules are built into the product:
- If a vendor declines your order, or doesn't accept it within 10 minutes, you are automatically refunded in full.
- You can cancelfor a full refund at any time before the vendor accepts. Once they've accepted, they've started cooking, so from that point cancellation is the vendor's call.
- If a vendor cancels an order they already accepted — they sold out, broke down, or had to close — you are refunded for what you paid.
- If something is wrong with your order, start at the window. Most of it gets fixed there, and a vendor can refund an order in full or in part. What we don't do is decide it for them by default: a refund after the food was made is their call, and an order that is never collected is not refunded automatically.
- If you can't resolve it with the vendor, email support@yumscout.app with your order code and we'll mediate. We're small and we actually read these.
Refunds are returned to your original payment method, typically within 5–10 business days depending on your bank. Your order screen distinguishes a refund we have started from one that has actually gone back— we don't tell you money has moved until it has.
5. Vendor terms
If you sell on YumScout, the following also applies to you:
- Fees. A YumScout subscription is $40/month with a 90-day free trial for every new vendor. A payment card is required to start the trial, and when the trial ends your card is automatically charged $40/month, renewing each month until you cancel (cancel anytime from your billing portal — cancel during the trial and you're never charged; cancel later and it takes effect at the end of the billing period). On each order we charge a 7% platform fee on the order subtotal — tips excluded. Stripe's standard card processing fees also apply to your sales, as they would with any card processor. We'll give at least 30 days' notice before changing fees.
- Payouts and identity. Order payments go to your own Stripe account, with payouts to your bank on Stripe's standard schedule. To sell, you must complete Stripe's identity verification ("KYC") and keep your Stripe account in good standing. Chargebacks on your sales are yours to answer, as merchant of record; when an order is refunded, our platform fee on it is refunded too.
- Your business, your responsibility. You are an independent business, not our employee, agent, or partner. Food safety, hygiene, permits, licenses, insurance, accurate menus and allergen information, pricing, and your sales taxes are entirely your responsibility. Listing on YumScout is not an endorsement, and our verification checks do not replace your legal obligations.
- Honest presence. Only go live where you actually are, and keep your menu and availability reasonably accurate. The live map only works if the pins are true.
- Suspension. We may suspend or remove a vendor — off the map, ordering paused — for violating these terms, for food-safety or fraud concerns, for repeated customer complaints, or for an unpaid subscription (you get a 7-day grace period on a failed payment before your pin comes down). Your data isn't deleted by suspension, and we'll tell you why it happened.
- Referral codes and the partner program. Some vendors and creators hold a personal YumScout referral code. Entering a valid code at signup makes your first paidsubscription month free (your fourth month, after the 90-day trial everyone gets), and YumScout pays that partner an amount equal to our platform fee on your orders during your first month — paid by us, out of our cut. It never changes what you or your customers pay. Codes can't be applied to your own account or retroactively, one code per vendor, and we may change or end the referral program for new signups at any time (codes already redeemed keep their benefit). Partners are independent promoters, not our employees or agents, and payouts to them are made through Stripe on a weekly schedule under the program's own written rules.
6. Reviews, photos, and your content
You own the content you post — reviews, ratings, photos, vendor profiles, and replies. By posting, you give YumScout a non-exclusive, worldwide, royalty-free license to host, display, and reproduce that content in order to operate and promote the Service (for example: showing your review on a vendor's profile, or a vendor's photos on the map). This license ends for content you delete, except where it has been anonymized as described in the Privacy Policy or where we need to retain it for legal reasons.
Ground rules for content and for using the Service generally:
- Reviews must reflect your genuine experience. No fake reviews, paid reviews, or review-bombing. You may not review a truck you own, and we block that automatically.
- If you run a truck, you arewelcome to review other trucks — a vendor's opinion of another vendor is worth hearing. When you do, your review is published with your truck name and a “Verified food truck” mark so readers know who is talking. That disclosure is automatic and cannot be turned off, and it links your account to your truck publicly.
- No harassment, hate, threats, spam, sexually explicit content, or other people's private information.
- Only post photos you took or have the right to post.
- Don't misuse the platform: no scraping, no interfering with the Service, no fake GPS locations, no using YumScout for anything illegal.
How these rules are enforced, including by software. Photos, videos and text you submit are checked automatically by a content classifier before they publish. Content the classifier refuses is not published; content it is unsure about publishes and is queued for a person to look at; repeated violations lead to strikes and, eventually, to a suspended account. That means an automated decision can block something of yours before any human sees it. You will be told when that happens and you can appeal it, and an appeal is reviewed by a person. Every review and photo also has report and block controls. Content reported by multiple users is hidden automatically pending review, and we may remove content or restrict accounts that break these rules. To report anything, use the in-app controls or email support@yumscout.app.
7. Disclaimers
Food is prepared and sold by independent vendors. YumScout does not and cannot guarantee food quality, safety, ingredients, allergen handling, or that a vendor holds every permit they need — those are the vendor's responsibility. If you have a serious food allergy, ask at the window.
The Service itself is provided "as is" and "as available." Live positions depend on GPS and vendors' phones; a pin may occasionally lag or a vendor may sell out before you arrive. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of liability
To the fullest extent permitted by law: YumScout is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data; and our total liability for any claim arising out of the Service is capped at the greater of $100 or the amounts you paid to YumScout (not to vendors) in the 12 months before the claim. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you — nothing here limits liability that cannot legally be limited.
If you are a vendor, you agree to indemnify YumScout against third-party claims arising from the food you sell, your business operations, or your violation of these terms.
9. Termination
You can stop using YumScout, or delete your account in the app, at any time. We may suspend or terminate accounts that violate these terms or create risk for the platform or its users; where reasonable, we'll warn you first. Sections that by their nature should survive termination (content license for retained records, disclaimers, liability limits, governing law) survive it.
10. Governing law and changes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes belong in the state or federal courts located in California. If a court finds part of these terms unenforceable, the rest stays in effect.
We may update these terms as the product evolves. When we do, we'll change the effective date above, and for material changes we'll notify you in the app or by email before they take effect. Continuing to use YumScout after a change means you accept the updated terms; if you don't, stop using the Service and delete your account.
